- Application
Your use of the Site (“SurveyNow.com” and/or “SurveyNow”) and/or the Digital Surveys must at all times be in compliance with these Terms and Conditions. These Terms and Conditions are subject to change at any time with or without notice. In such instances, we will revise the “last updated” date at the top of the Terms and Conditions. You accept that any changes to the Terms and Conditions will be binding on you, and that your use of the Site and/or the Digital Surveys will at all times be subject to the Terms and Conditions that are in force at the time that you use the Site and/or the Digital Surveys. Your continued use of the Site and/or the Digital Surveys after the effective date of a change will amount to acceptance by you of the changed Terms and Conditions.
It is your responsibility to check these Terms and Conditions from time to time to learn of any changes to the Terms and Conditions.
- Who may use the Site and the Digital Surveys?
Unless otherwise specified, the Site and/or the Digital Surveys are intended for your personal, non-commercial and lawful use only. If you are under the age of 18, you must have the consent or permission of your parent or guardian to complete a Digital Survey and you will be asked to confirm that you have the necessary consent. Corporate entities may not use the Site and/or the Digital Surveys without the prior written consent of SurveyNow.com.
SurveyNow.com reserves the right, in its sole and absolute discretion, to disqualify any Survey Respondent from a Digital Survey.
No person may establish or maintain more than one account with a panel, and each account must have a unique and valid e-mail address and password.
Panelists will endeavor to provide substantive information relevant to the nature and context of each survey, and to be honest and thorough as possible.
- How does a Digital Survey work?
Once you have indicated that you wish to participate in a Digital Survey, you will receive an SMS or email, which is sent to the cell phone number or email address that you have provided for this purpose, containing a link to the Digital Survey. Alternatively, an SMS or email may have been forwarded to you by someone you know. You may, at this stage, still decide whether you want to participate in the Digital Survey. You may also opt-out of receiving further communications from SurveyNow.com.
By clicking on the link contained in the SMS or email, you will be transferred to a web-based Digital Survey, which you will be required to complete.
You may receive an incentive to complete a Digital Survey in the sole and absolute discretion of SurveyNow.com. You will only be eligible for this incentive provided that you are not disqualified from completing the Digital Survey for any reason, including for failing to satisfy any or all of the recruitment criteria for a specific Digital Survey. SurveyNow also reserves the right not to give you an incentive for completing a Digital Survey if, in the sole and absolute discretion of SurveyNow, the quality and content of your response is not satisfactory, or you have submitted duplicate interviews.
If you qualify for an incentive or gift voucher incentive for the completion of a Digital Survey, you may receive an SMS from our mobile solutions partner either confirming the automatic top-up of your mobile phone account or containing one or more mobile airtime voucher code(s) or gift voucher code(s) upon your completion of the Digital Survey. If you are sent voucher codes or gift voucher codes, you must redeem the voucher or gift voucher incentive, using the voucher code(s) provided, within 30 (thirty) days of receiving the SMS containing the voucher code(s). You are responsible for informing SurveyNow immediately, or within 14 (fourteen) days after completing the Digital Survey, if you have not received your SMS or email containing an update of the incentive payment or if you are experiencing any difficulties in redeeming your voucher code(s) or incentive. If you do not notify SurveyNow that you have not received an SMS containing voucher code(s) or gift voucher code(s), or if you do not notify SurveyNow that you are experiencing difficulties with redeeming your voucher code(s), within the stipulated time period, then SurveyNow will cancel your mobile airtime voucher or gift voucher incentive and return the voucher code(s) to stock. SurveyNow and its clients will have no responsibility or liability for any claim, loss, injury or damage arising out of or in connection with you not receiving or redeeming the mobile airtime voucher code(s) or gift voucher code(s) within the stipulated time period or in respect of any network failure that results in you not receiving the SMS.

Tracking of the Answers of Recurring Respondents (special research design projects) |
When you participate in our surveys, we typically use a temporary ID which makes your answers in the survey anonymous to our clients. However, some of our clients have the specific research design need to understand how your opinion has evolved over a period of time. For this specific project type that we call “tracking” projects we will use persistent IDs and we will make this clear at the beginning of each of these surveys. Your survey responses will be considered as personal data and you will have the right to access them. Such projects will contain a notice on the very first page of the survey, so that you can identify them and decide whether to take part. |

Data Matching and Enrichment |
We enrich the data we hold on file about you by matching your personal data with third parties. This will help us to improve your panel profile and ensure that we select relevant surveys for you. We utilize matching services (i.e. third parties who are specialized in data management) to acquire additional information about you from public and private data sources (such as social networks, retailers and content subscription services with whom you have an account) or to use your personal data as an aid to develop additional or new types of anonymous data sets (i.e. we compile your aggregate data with data from other consumers to create a new lifestyle segment). The matching service (our partner) holds the personal data we share for a short time, uses it to assemble the additional information, and then return the combined information to us. Partners are contractually bound to delete the data we share with them or and are not authorised to use it in any way other than for this specific purpose. Advertising Targeting and Media Buying Research |
We use your personal data to help our clients and vendors enrich their data by using lookalike modelling techniques. Thanks to your participation in our surveys and your profile data, we can help our clients to improve their advertising targeting, and to create better online advertising models, through lookalike modelling or similar research methodologies. We will use your personal data we collect about you through profile building, participation in research surveys or data matching to match with third-parties and platforms (our partners). We include contractual safeguards to ensure that you will not automatically be targeted for commercial purposes, as a result of your data being used to help create a lookalike audience, and that our partners cannot use your data for any other purpose. - How to opt-out
Should you wish to exercise the option to “opt-out” of any of our communications or to remove any of your personal information from our servers, including from our segmented database of respondents, you can do so at any time by either:
- using the opt-out facility in any SMS or other electronic communication from us;
- Confidentiality
As a member of our panel, you will be exposed to some new products and innovative ideas from our clients and we ask that you do not share any of the information relating to the products or the research activity in which you participated, via any medium.
If SurveyNow has reason to believe you have shared material containing our client’s intellectual property outside the context of the research activity, your membership may be terminated.
- Liability
SurveyNow will not be liable for any claims, losses, including but not limited to direct, indirect, special, economic and consequential loss or damage(including but not limited to loss of profits, loss of revenue or loss of goodwill), whether in contract, negligence or other tortious action arising out of or in connection with the use of this service.
