SurveyNow Terms of Service

Welcome to SurveyNow (referred to herein as “SurveyNow”, “we”, “us”, or “our”). These Terms of Service (collectively, the “Terms”) constitute a legally binding agreement between you and SurveyNow governing your access to and use of the SurveyNow website, mobile applications, software, platforms, and any related services (collectively, the “Service”).
By accessing, downloading, registering for, or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not unconditionally agree to all of the terms and conditions herein, you are prohibited from using the Service and must immediately discontinue any use thereof.
Definitions For the purposes of these Terms:
- “Member” or “You” means any individual or entity that accesses or uses the Service.
- “Account” means the personalized registered user account created on the Service.
- “SurveyNow Surveys” means surveys, tasks, or opportunities owned, operated, administered, or directly managed by SurveyNow, for which SurveyNow determines eligibility and assumes responsibility for any Rewards.
- “Third-Party Surveys” means surveys, tasks, reward offers, referral programs, or opportunities provided, administered, or facilitated by third-party providers and accessible via the Service.
- “Rewards” means any incentives, including but not limited to vouchers, gift cards, airtime credits, cash equivalents, merchandise, or other benefits, offered subject to eligibility, completion, and verification requirements.
- “Points” means virtual in-app points, credits, scores, or gamification units (including Pulse Points), which possess no intrinsic monetary value, are not redeemable for cash unless expressly stated, and confer no property rights.
- “Pulse” means SurveyNow’s proprietary engagement features, including content feeds, polls, news, participation tasks, and gamified elements that may award Points.
Description of the Service SurveyNow operates a platform that facilitates access to market research opportunities, including SurveyNow Surveys, Third-Party Surveys, engagement features such as Pulse, and associated reward and points systems.
SurveyNow is not a financial institution, payment processor, investment platform, employer, or guarantor of any outcomes. Participation in the Service is entirely voluntary and does not establish any employment, agency, partnership, or fiduciary relationship between you and SurveyNow.
Eligibility and Registration To access or use the Service, you represent and warrant that:
- You are at least 18 years of age or have attained the age of majority in your jurisdiction of residence, whichever is greater;
- You possess the legal capacity and authority to enter into a binding contract;
- You will provide accurate, current, and complete information during registration and maintain its accuracy;
- Your use is for personal, non-commercial purposes only; and
- You will comply with all applicable laws, regulations, and these Terms.
SurveyNow reserves the absolute right, in its sole discretion and where permitted by applicable law, to refuse registration, restrict or limit access, suspend or terminate any Account, restrict survey eligibility, or require additional verification at any time without prior notice or liability.
Account Registration, Security, and Verification 4.1 Registration You agree to provide truthful, accurate, current, and complete information during registration and to promptly update such information to maintain its accuracy.
4.2 Account Security You are solely responsible for safeguarding the confidentiality of your login credentials and for all activities that occur under your Account. You agree to immediately notify SurveyNow of any unauthorized use or suspected breach of security.
4.3 Verification SurveyNow may, at any time and in its sole discretion, require verification of your identity, eligibility, device, location, or other attributes, including through third-party services. You hereby authorize SurveyNow to undertake reasonable measures to verify information and prevent fraud. Failure to complete verification may result in withholding of Rewards, restriction of features, or termination of your Account.
Surveys, Participation, and Quality Standards 5.1 Availability Survey availability is contingent upon demographic profiling, quota fulfillment, geographic restrictions, client requirements, and other factors. SurveyNow provides no guarantee of survey availability, qualification, or completion opportunities.
5.2 Participation Requirements You agree to participate honestly, provide consistent and truthful responses, complete surveys personally without assistance from automation or third parties, and adhere strictly to all instructions.
5.3 Disqualification and Quality Controls You may be disqualified, and any associated Rewards or Points reversed, for reasons including but not limited to: failure of screening criteria, quota closure, detection of inattentive or inconsistent responses, low-quality submissions, technical issues, or rejection by a survey sponsor.
5.4 Interruptions Surveys may be paused, closed, or withdrawn without notice. SurveyNow shall not be liable for any loss, inconvenience, or damages arising from unavailability, interruptions, or technical failures.
Rewards, Points, and Redemption 6.1 SurveyNow Surveys For SurveyNow Surveys, Reward eligibility is determined solely by SurveyNow based on verified completion, quality standards, and compliance. SurveyNow reserves the right to delay, withhold, reverse, or deny Rewards in cases of suspected fraud, breach of Terms, multiple Accounts, automated activity, or incomplete verification.
6.2 Third-Party Surveys Third-party providers bear sole responsibility for validation, timing, and issuance of Rewards associated with Third-Party Surveys. SurveyNow disclaims any liability for delayed, missing, reversed, or denied third-party Rewards, provider insolvency, policy changes, or technical errors. Participation in Third-Party Surveys is subject to the third party’s separate terms and at your sole risk.
6.3 Points and Gamification Points are awarded at SurveyNow’s sole discretion for engagement purposes and, unless explicitly stated otherwise, have no cash or monetary value, are non-transferable, non-refundable, non-saleable, and confer no property interest. SurveyNow may modify earning rates, redemption options, impose expiry, adjust balances for errors or fraud, or suspend Points functionality without notice.
6.4 Redemption Redemption of Rewards or Points, where available, is subject to minimum thresholds, geographic availability, verification, compliance checks, and processing delays. SurveyNow may reject redemption requests upon reasonable suspicion of fraud, abuse, or non-compliance.
6.5 Expiry and Forfeiture Unredeemed Rewards and Points may expire or be forfeited due to Account inactivity, suspected abuse, termination, or legal requirements. To the fullest extent permitted by law, terminated Accounts forfeit all accrued but unredeemed value.
6.6 Taxes and Reporting You are solely responsible for any taxes, duties, declarations, or compliance obligations arising from Rewards or benefits received through the Service.
Prohibited Conduct You agree not to engage in any activity that:
- Involves automation, bots, scripts, proxies, VPNs, or location spoofing;
- Creates or operates multiple Accounts;
- Manipulates surveys, responses, or reward mechanisms;
- Falsifies information or engages in fraudulent conduct;
- Interferes with Service functionality, security, or integrity; or
- Violates any applicable law or third-party rights.
SurveyNow may monitor activity, investigate violations, and take remedial action, including Account termination, forfeiture of Rewards/Points, and reporting to authorities.
Pulse and Engagement Features Pulse features are provided for entertainment and engagement only. Content therein does not constitute professional, financial, medical, or legal advice. SurveyNow reserves the right to modify or discontinue Pulse without liability.
User-Generated Content Where the Service permits submission of content (“User Content”), you grant SurveyNow a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use, host, display, modify, and distribute such content for operational and promotional purposes. You warrant that User Content does not infringe third-party rights or violate law.
Third-Party Services and Links The Service may contain links or integrations with third-party services. SurveyNow assumes no responsibility for third-party content, practices, availability, or data handling.
Privacy and Data Protection Your personal data is processed in accordance with our Privacy Policy available at: https://surveynow.com/privacy-policy/. You consent to data sharing with sponsors, partners, and service providers as necessary for Service operation.
Intellectual Property All intellectual property rights in the Service are owned by SurveyNow or its licensors. You are granted a limited, revocable, non-exclusive license for personal use only.
Suspension, Termination, and Service Changes SurveyNow may suspend, restrict, or terminate your access at any time for any reason, including breach of these Terms, with or without notice. SurveyNow may also modify or discontinue the Service without liability.
Disclaimers THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. SURVEYNOW DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, AND REWARD ENTITLEMENT.
Limitation of Liability TO THE FULLEST EXTENT PERMITTED BY LAW, SURVEYNOW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES. SURVEYNOW’S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF THE VALUE OF REWARDS ISSUED BY SURVEYNOW TO YOU IN THE PRECEDING 30 DAYS OR USD $10 (OR EQUIVALENT).
Indemnification You agree to defend, indemnify, and hold harmless SurveyNow, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, breach of these Terms, or violation of law.
Electronic Communications You consent to receive all communications, including notices and disclosures, electronically via email, in-app messages, or postings on the Service.
App Store Providers These Terms are solely between you and SurveyNow. Apple Inc., Google LLC, and other app store providers are not responsible for the Service or its content.
Force Majeure SurveyNow shall not be liable for failures or delays caused by events beyond its reasonable control.
No Agency or Partnership These Terms do not create any agency, partnership, joint venture, or employment relationship.
Assignment SurveyNow may assign these Terms without restriction. You may not assign your rights without prior written consent.
Severability and Waiver If any provision is held invalid, the remainder shall continue in full force. No waiver of any term shall be deemed a continuing waiver.
Entire Agreement These Terms, together with the Privacy Policy and any posted guidelines, constitute the entire agreement between you and SurveyNow, superseding all prior understandings.
Amendments SurveyNow may amend these Terms at any time by posting revised versions on the Service. Continued use constitutes acceptance of amendments.
Governing Law and Dispute Resolution These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to conflict of laws principles. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the competent courts in South Africa.
